Because of a doctor’s failure to simply follow the standard diagnosis protocol for breast cancer, a young woman’s cancer went untreated for years as it grew. When it was finally discovered as a stage IV malignancy, the woman required multiple surgeries and chemotherapy.

The woman was only 35 years old when she informed her doctor of a hard mass at the three o’clock position on her left breast. Her doctor ordered an ultrasound but no mammogram. The ultrasound found a 1.9cm mass, but the doctor told her not to worry about it and to return if she noticed changes.

However, that course of action is clearly negligent. Doctors are required to order a surgical consult and fine needle biopsy of such masses (either a solid tumor or complex cyst). Only if the sonogram identified the mass as a simple cyst would no further action be required.
