As noted above, it’s not easy to collect compensation for pain and suffering, as placing a monetary value on this type of damage is challenging. Generally, there are two ways to calculate pain and suffering damage:
- Per diem method: Your damages are calculated on a “per day” basis between the date of your injury and the date when your medical provider releases you from treatment.
- Multiplier method: By using your medical expenses as a basis for damages, this method allows you to obtain compensation in line with the severity of your injuries and recovery time associated with them.
